  • Tell us your name and account number
  • Describe the error you believe has occurred. Explain as clearly as you can why you believe it is an error or why you need more information.

Qualified Written Notice of Error

If you prefer a written response, please provide the error in writing. Within 5 days of receiving a written error notice acknowledge receipt of the error notice. We will determine whether an error occurred no later than 30 business days after receiving written notice of the asserted error. If we need more time, we may extend the time period for investigating and responding to a written notice of error by 15 business days; however, we will notify you before the end of the 30 day period of the extension and the reasons for the delay in responding.

If the asserted error is regarding a payoff balance, we will respond no later than 7 days after receiving written notice of the asserted error. If the asserted error is regarding errors relating to foreclosure, we will respond prior to the date of the foreclosure sale or within 30 days of receiving the written notice of error. We may not extend the time period investigating and responding to a written notice of error if the asserted error is regarding a payoff balance or related to foreclosure.

You may ask for copies of the documents we used in our investigation, we will provide such documents at no charge within 15 business days of receiving the requests.

The Qualified Written Notice of Error applies to the following categories of errors:

  • Failure to accept a payment that conforms to any written requirements the consumer must follow in making payments to us;
  • Failure to apply an accepted payment to principal, interest, or other charges under the terms of the mortgage loan and applicable law;
  • Failure to credit a payment to a consumerís mortgage loan account as of the date of the receipt;
  • Imposition of a fee or charge we lack a reasonable basis to impose upon the consumer, which includes, for example, a late fee for a payment that was not late, a charge we imposed for a service not provided, a default property-management fee for consumers who are not in a delinquency status that would justify the charge, or a charge for force-placed insurance in a circumstance not permitted by the force-placed insurance provisions;
  • Failure to provide an accurate payoff balance amount upon a consumerís request within 7 days;
  • Failure to transfer accurately and timely information relating to the servicing of a consumerís mortgage loan account to a transferee servicer;
  • Any other error relating to the servicing of a consumerís mortgage loan.

We are not required to responds to assertions of errors regarding:

  • Errors relating to the origination of a mortgage loan,
  • The underwriting of a mortgage loan,
  • Subsequent sale or securitization of a mortgage loan,
  • The determination to sell, assign, or transfer the servicing of a mortgage loan.

Any Notice of Error received verbally is not subject to the notifications and time limits required under a qualified written Notice of Error.

For the purpose of Information Request, servicing is defined as:

  • Receiving any scheduled periodic payments from a borrower pursuant to the terms of any federally related mortgage loan and making the payments to the owner of the loan or other third parties of principal and interest and such other payments with respect to the amounts received from the borrower as may be required pursuant to the terms of the mortgage servicing loan documents or servicing contract.

Hours of operation for receiving Residential Real Estate Loan payments and Credit Line Loan payments are 8:30 am Ė 4:30 pm, Monday Ė Thursday, and 5:00 pm Friday, except bank holidays. All other payments received will be credited as of the next loan operations business day or as otherwise permitted by law. Loan Payments Received Through Online Banking - Payments to a First Community Bank loan initiated through our Online Banking BILL PAYMENT service must be submitted 2 days prior to the delivery date (Not the Preferred Method). Payments to any First Community Bank loan initiated through our Online Banking TRANSFER service must be received by 5:00 pm, Monday - Thursday, and 6:00 pm, Friday, except bank holidays, to be credited as of the date of transfer (Preferred Method). All other payments initiated through our Online Banking TRANSFER service after the above mentioned time frames will be credited as of the next loan operations business day or as otherwise permitted by law.
